Will I Lose My Licence for Drink Driving in New Zealand?
If you have been charged with drink driving in Auckland, one of your biggest concerns may be whether you will lose your driver's licence. The good news is that there may be legal options worth exploring before you assume you will lose your licence for the full period or receive a criminal conviction.
Whether you can keep driving depends on your alcohol level, the charge you are facing, your driving history and the circumstances of your case.
As a drink driving lawyer, I can review the evidence, assess whether there are grounds to defend the charge and explain what options may be available to protect your driving privileges.
Can I avoid losing my licence?
In some cases, it may be possible to challenge the charge successfully. If the prosecution cannot prove the offence and you are found not guilty, you will not be disqualified as a result of that charge.
Where a defence is not available, there may still be other options to consider. Depending on the circumstances, these could include an alcohol interlock sentence or, where legally available, an application for a limited licence.
A limited licence can allow you to drive for specific purposes and at specified times if the legal requirements are met. The court generally needs evidence of extreme hardship to you or undue hardship to someone else. Restrictions apply, and not everyone is eligible.

Can I avoid a criminal conviction?
In appropriate cases, it may also be worth exploring an application for a discharge without conviction.
This is where the court discharges you without recording a conviction, even though the charge has been proved or admitted. The court applies a demanding legal test, considering whether the consequences of a conviction would be out of all proportion to the seriousness of the offence.
Importantly, a discharge without conviction does not automatically mean you can keep your licence. The court may still impose a driving disqualification in certain circumstances.

How can a drink driving lawyer help?
I can assess your case, review the available evidence and explain whether there are realistic grounds to defend the charge or seek a different outcome.
If you rely on your licence for work, family responsibilities or everyday life, it is important to explain those circumstances early so I can assess which legal options may be available.
Every case is different, and no particular outcome can be guaranteed. However, getting advice early can help you understand your position before making important decisions about your plea.
If you have been charged with drink driving in Auckland, contact a drink driving lawyer to discuss your circumstances and the options available under New Zealand law.
